Simply locating a criminal conviction is not enough to eliminate an employment candidate. While you may eliminate an applicant based on previous criminal convictions you must follow a set of criteria to make sure you are not in violation Under Title VII of the Civil Rights Act of 1964.
The EEOC mandates that the employer develops a targeted screen, considering at least the nature of the crime, the time elapsed, and the nature of the job.
The EEOC also states convictions must be validated.
